Santa’s Top 5 Patient Privacy & Data Security Shame List
1. You’re on Santa’s shame list if you forgot to encrypt 780,000 patient records and/or you had your “unecrypted” laptop, USB drive or smartphone stolen or lost during 2012.
Santa’s Response? If only you had remembered to “encrypt” your PHI you would not be on his shame list this year.
Santa’s Tip: Encrypt, Encrypt, Encrypt!
2. You still don’t know what “HIPAA” stands for? Perhaps this may help – “HHS Investigates Protecting Patient-Privacy Act”
Santa’s Response? Let’s give HIPAA a makeover by adding another “P” –Healthcare Incorporates Protecting Patient Privacy Act. (HIPPA)
Santa’s Tip: 1. Incorporate “HIPPA” in 2013, as he does not want to see you on the “Wall of Shame!”and 2. Explore the purchase of a cyber risk insurance (aka, “privacy and security”) policy from Cyber Data Risk Managers to transfer your residual data privacy and security risk.
3. Did you forget about “BYOD?” Santa is scratching his head after hearing you forgot to incorporate “BYOD” into your security policies and procedures after learning that Dr. Patel lost his unecrypted personal laptop that had PHI on it –and- that the iPad gift he gave Dr. Patel last year is now being used at the hospital.
Santa’s Response? Let’s give BYOD a new definition – Bury Your (Healthcare) Organizaton’s Data. (BYOD)
Santa’s Tip: Explore (MDM) Model Device Management in 2013 and “wrap” a layer of protection around those devices.
4. Your name is on the “Wall of Shame!”
Santa’s response? No comment.
Santa’s Tip: Do your best to keep your name off the “shame on you” list in 2013!
5. Dr. Patel still thinks its ok to post pictures of his patient’s surgery on Facebook or “friend’ a patient he performed a surgery on recently.
Santa’s Response? Patient’s identities and PHI need to stay private.
Santa’s Tip: Incorporate social media into your privacy policies in 2013 and don’t socialize online with your patients.
While the above is no laughing matter, perhaps incorporating some of Santa’s Tips will help keep you off Santa’s Shame List in 2013 (and HHS’ “Wall of Shame”).
